Terms of Service

By accessing the aiapps365 website, submitting a form on this site, or initiating an SMS conversation with our published phone number, you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy. If you do not agree, do not use the site or contact us through it.

aiapps365 is a product of Avant-Garde Global LLC, a California limited liability company. References to "we", "us", and "aiapps365" mean Avant-Garde Global LLC operating under the aiapps365 brand.

aiapps365 is a business-to-business AI phone-receptionist platform for service businesses (currently HVAC and plumbing). The service answers inbound calls, handles inbound SMS conversations, books appointments to a connected calendar, and routes leads to a tenant administration console.

These Terms cover your use of the public-facing portions of the site (marketing pages, demo booking, contact forms, SMS) and any informal communication you initiate with us. They do not cover the operation of the service for paying tenant businesses, which is governed separately (see the Tenants vs visitors section).

These Terms apply to "visitors": anyone using the public site, the demo booking form, the contact form, or our published SMS number without a paid subscription.

Paying tenant businesses (and their authorized staff acting on the tenant's behalf) are governed by the signed Master Services Agreement ("MSA") between the tenant and Avant-Garde Global LLC. The MSA controls in any conflict between these Terms and the MSA. Tenant businesses can request the current MSA template by emailing legal@aiapps365.com.

You must be at least 18 years old and acting on behalf of a US-registered business (or an individual sole proprietor doing business in the United States) to create an account, submit a demo request, or initiate an SMS conversation that includes business inquiries.

You are responsible for maintaining the confidentiality of any account credentials issued to you, and for all activity under your account. Notify us immediately if you believe your credentials have been compromised.

You agree not to:

Use the service for any unlawful purpose, including harassment, threats, or activity prohibited by US federal, state, or local law.

Submit forms or send SMS containing spam, malware, phishing links, or content that infringes a third party's intellectual property or privacy.

Probe, scan, or test the vulnerability of any part of the service, or attempt to circumvent any security or rate-limiting measures (including the inbound-SMS spam-guard).

Scrape, crawl, or programmatically extract content from the service in a way that imposes unreasonable load. AI engines that respect our `robots.txt` allowlist are welcome to index public marketing pages.

Resell, sublicense, or whitelabel the service without our prior written consent (such consent is governed by the MSA, not these Terms).

Reverse-engineer the AI receptionist behavior, prompts, or model outputs for the purpose of replicating the service.

Impersonate any person or business in a form submission or SMS conversation.

You consent to receive automated SMS replies from aiapps365 when you initiate an SMS conversation by texting our published toll-free number (currently (855) 628-5637). Messages reply to the menu options described on our /contact page (hours, services and pricing, scheduling a demo, requesting a callback, receiving an information packet, leaving a message, or talking to a person).

Message frequency varies with the conversation; a typical menu interaction is between two and six messages. You will not receive marketing or promotional messages from us — every outbound SMS is a direct reply to one of your inbound messages.

Reply HELP for help. Reply STOP at any time to opt out. STOP is honored automatically and the phone number is durably suppressed in our database; future inbound from a phone that has replied STOP is silently dropped. To re-subscribe, reply START.

Standard message and data rates from your carrier may apply. We are not responsible for charges your carrier imposes for sending or receiving SMS.

aiapps365 provides an AI receptionist that uses language models to interpret callers and texters. Like all AI systems, the receptionist can be wrong: it can mis-hear, mis-categorize an intent, mis-quote a price, schedule an appointment at the wrong time, or fail to understand a request entirely.

If you book an appointment, request a callback, or transmit information through the AI receptionist as part of a public-facing interaction with us, you remain responsible for verifying the result through a non-AI channel (e.g. confirming the appointment time directly with us by reply email).

We do not guarantee that the AI receptionist will be available or operational at any specific time. We do not guarantee any specific response latency, accuracy, or quality. We do not provide an uptime SLA on the public-facing service.

All content on the aiapps365 site (text, layout, code, graphics, logos) is owned by Avant-Garde Global LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.

You retain ownership of any content or data you submit to us through forms or SMS (subject to our right to use it for the purposes described in our Privacy Policy). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use it as needed to deliver the service and respond to your inquiry.

Use of the public marketing site, the demo booking form, the contact form, and the inbound SMS menu is free. We do not bill visitors for any of the activities covered by these Terms.

Subscription pricing for tenant businesses is published on our /pricing page and is governed by the signed MSA. Refund policy and cancellation terms for paying tenants live in the MSA, not in these Terms.

We may suspend or terminate your access to the public site or our SMS number at any time, with or without notice, for any reason including (without limitation) violation of these Terms, abuse of the service, or carrier-compliance reasons (e.g. suspected SMS spam).

You may stop using the site at any time. To opt out of SMS, reply STOP to any message we have sent you.

THE SITE AND THE SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVANT-GARDE GLOBAL LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, OR (b) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA OR TRANSMISSIONS.

Nothing in these Terms limits or excludes our liability for our gross negligence, willful misconduct, or any liability that cannot be limited or excluded under applicable California law.

For paying tenant businesses, the MSA contains a separate liability cap (typically the fees paid in the preceding 12 months); these Terms do not control that cap.

You agree to defend, indemnify, and hold harmless Avant-Garde Global LLC and its affiliates from any third-party claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms, (b) your violation of any law or third-party right in connection with your use of the site, or (c) any content you submit to us.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the site that is not resolved informally will be litigated exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

An optional binding arbitration clause is under attorney review and may be added to a future revision of these Terms. When added, it will not deprive you of any right that cannot be waived under California law.

We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Material changes will be announced on the aiapps365 site. Your continued use of the site after a revised version takes effect constitutes acceptance of the changes.
